What CONFOTUR is—and why the distinction matters

CONFOTUR is the Dominican Republic’s Tourism Promotion Council. It administers the incentive framework created by Law 158-01 and its amendments for tourism projects that meet legal, technical, environmental and financial requirements.

The phrase “CONFOTUR property” can therefore be misleadingly broad. The practical questions are whether the development obtained classification, whether its resolution remains valid and whether the specific benefit applies to the unit and transaction you are considering.

Potential benefits and their limits

The official CONFOTUR portal lists incentives that may apply to qualifying new projects, including exemptions connected with real estate transfer, property tax, first installation, specified equipment and covered business activity.

Benefits are not automatic or identical in every project. Classification terms, approved activity, purchase timing and administrative procedures determine the outcome. Marketing language should never replace the resolution and independent professional advice.

  • Request a legible copy of the classification resolution.
  • Confirm whether it is provisional or definitive and check its number, date, holder and project.
  • Obtain written confirmation of the taxes and transaction covered.

Duration, location and resale

Official information describes a 15-year exemption period from completion of construction, subject to the framework and the project’s conditions. That does not mean every unit and every tax are automatically covered for 15 years.

Law 195-13 expanded the regime to areas of tourism or ecotourism potential nationwide, but location alone does not qualify a development. Later transfers to third-party buyers must not be assumed to retain the initial benefit; a resale requires its own legal and tax review.

Documents to review before investing

Definitive classification requires a substantial file, including promoter information, corporate documents, property or use rights, feasibility analysis and relevant approvals. Published requirements include valid environmental authorization and land-use or municipal approvals.

Review title, legal status, permits, contract, construction record, operating plan and the exact scope of the resolution with independent professionals. A tax incentive can improve a project’s economics, but it cannot compensate for weak documentation, an unsuitable location or unrealistic operating assumptions.
